Qapper® Terms of Use

Use of the Qapper® software is subject to acceptance of the terms of use described in this document.

Legal Agreement

This document is a legal agreement between the company "Infortecno Sistemas LTDA", a legal entity registered under CNPJ No. 02.364.542/0001-79, headquartered at Avenida Paulista, No. 1471, 5th Floor, Suite 511, hereinafter referred to as LICENSOR, and the contractors, referred to as ESTABLISHMENT or USER.

Definitions

LICENSOR: The company "Infortecno Sistemas Ltda", owner of the Qapper® application. ESTABLISHMENT: The individual or legal entity owning the commercial establishment whose business activities cover any service provision area with scheduled appointments, using the Qapper® application. USER: The ESTABLISHMENT's client, user of the Qapper® application.

Purpose

The purpose of this document is to govern the access and use by the ESTABLISHMENT and USER, describing the rules applicable to the use of the Qapper® application, under trademark registered by the LICENSOR, according to the following terms:

Intellectual Property

The Qapper® product is owned by Infortecno Sistemas. Neither the ESTABLISHMENT nor the USER acquires with the installation and use of the product any intellectual property rights or other exclusive rights to the Qapper® application, including trademarks, designs, patents, copyrights, or any rights to confidential information or trade secrets.

Privacy Policy

The privacy policy, available in the Qapper® application or on our website, describes how your personal data is collected and processed. By using our services, you understand that we will collect and use some of your personal information, under the Data Protection regulations (LGPD, Federal Law 13.709/2018).

Services Offered

The LICENSOR is an independent company with no employment or corporate relationship with the ESTABLISHMENT or USER, acting solely as a software licensing service provider and service intermediary between the parties through the Qapper® application.

The Application

The Qapper® application's main purpose is to manage appointments for professionals and establishments that work with scheduled appointments, better organizing the business and automating routines. It primarily consists of bringing users and establishments closer, allowing clients free access to information about schedule availability, enabling them to make appointments by choosing services, professionals, dates, and times. The app is available for mobile devices in a cloud environment, 24/7.

App Installation

Both the ESTABLISHMENT and USER have free access to download and install the Qapper® application.

App Access

Both the ESTABLISHMENT and USER declare they are aware that they need stable internet access for the proper functioning of the Qapper® application.

Updates and Maintenance

The LICENSOR reserves the right to implement updates, improvements, or fixes to the Qapper® application whenever necessary, including temporary service interruptions. When possible, updates will be announced in advance. Occasional unavailability does not generate rights to compensation or refund.

Application Registration

Both the ESTABLISHMENT and USER, when registering, must create a login and password to access the Qapper® application. These credentials are personal, non-transferable, and entirely the responsibility of the holder, with the sale, rental, loan, or any form of account sharing prohibited. Registration requires providing true information, whose accuracy is the user's sole responsibility. The LICENSOR reserves the right to suspend or limit access to the application in case of incorrect, unconfirmed data, or improper account use. Upon completing registration, the ESTABLISHMENT agrees that their profile may be publicly displayed on Qapper®, visible to other platform users to facilitate new appointments.

Responsibility for Data Insertion and Availability

By using the Qapper® application, you assume full responsibility for the information entered, modified, or deleted, whether in writing, audio, or images, with the understanding that under no circumstances is it permitted to provide pornographic, religious, political, or any other type of content that may cause any form of harm or damage to users, companies, and society in general.

Service Availability

The LICENSOR maintains contracts with renowned companies in the technology market with updated and highly available resources; however, technical failures may still occur, and in such cases, we may depend entirely on these providers to restore services.

Data Storage Responsibility

It is the LICENSOR's responsibility to protect, through storage on high-security servers, the data and confidentiality of all information registered through the Qapper® application. However, it is necessary to highlight that, despite all our security protocols, as well as those of our suppliers and partners, problems caused exclusively by third parties may occur, such as cyberattacks by hackers, or also as a result of the user/client's own negligence or imprudence.

Plan for the Establishment

The monthly payment will be made to the LICENSOR by bank slip or credit card, according to the chosen plan, whose values and rules are available on the website and application. The ESTABLISHMENT agrees that the monthly fee will be adjusted annually according to the IGP-M from FGV, or a substitute index. Qapper® offers a 7-day free trial period for new ESTABLISHMENTS, counting from service activation.

Refund Policy

The ESTABLISHMENT declares to be aware that the amounts paid for Qapper® plans, whether monthly or annual, are non-refundable, regardless of the time of use, early cancellation, or reason for withdrawal. By contracting any plan, the ESTABLISHMENT agrees with this policy, expressly waiving any claim for refund of amounts already paid.

Establishment's Default

In case of late payment of the monthly fee by the ESTABLISHMENT for more than 5 consecutive days, the Qapper® application functionalities will be suspended until the pending installment is settled. In case of non-payment for 30 consecutive days or more, the ESTABLISHMENT will be notified and questioned about the interest in continuing or not with the plan for access to the Qapper® application. In case of no response or lack of interest in continuing with the Qapper® application, the plan will be automatically suspended, making all functionalities unavailable, as well as all information while the financial default persists.

Responsibilities Regarding Appointments

The LICENSOR is not responsible for delays, cancellations, no-shows, or for the provision of services between USER and ESTABLISHMENT, this relationship being the sole responsibility of the involved parties.

Plan for the User

The installation and use of the Qapper® application by the USER will always be free.

User's Scheduling

The USER is aware that whenever making an appointment, they must arrive at the establishment at least 5 minutes early. If cancellation is needed, try to do it in advance, always respecting the professionals.

User's Payment to the Establishment

Payment for services will be made directly to the establishment on the scheduled date.

Licensor's Support

For questions or technical support needs, the Qapper® client can contact us by accessing the chat on our website or through the application. Our support hours are Monday to Friday, from 08:00 to 18:00, and the maximum response time is 48 business hours.

Term Duration

This document will take effect on the contracting and acceptance date by the ESTABLISHMENT, and the Qapper® licensing term will be valid according to the plan chosen at the time of contracting, with no mandatory contracts or fine print between the parties, and may be canceled at any time. If the ESTABLISHMENT chooses to continue paying the monthly fees, the system will automatically consider renewal for another month.

This Term and Possible Changes

This term can be consulted and read at any time by accessing our website or the Qapper® application. Its content or part of it may be modified at any time, considering possible improvements to the services provided. The ESTABLISHMENT or USER may oppose any modified terms, in writing, by sending an email to suporte@qapper.com.br and requesting the cancellation of their Qapper® application registration.

Acceptance

I declare that I have read, understood, and accepted all the terms and conditions contained in this document. I further declare that I am aware of the rights and obligations arising from these terms, this instrument constituting the complete agreement between the parties.

Jurisdiction

The parties elect the jurisdiction of the District of São Paulo, SP, to resolve any disputes that may arise from the interpretation and compliance with this term.
